Statutory Information Gateways & Restrictions

Legislation may contain provisions, which permits the disclosure of information or enables information to be provided or both. This normally relates to a specific purpose/regime and the information is often restricted by statute.

Section 2 of the Police Act 1997 enables NCIS to disclose information on criminal intelligence information with police forces and other law enforcement agencies.

Certain legislative provisions prohibit the disclosure of certain types of information in certain circumstances to other agencies. These are unlikely to affect the majority of information exchanges for crime and disorder work, although care must be taken to ensure that they are complied with. In most circumstances, the agencies holding the information will be aware of any specific restriction on its disclosure.
